A federal judge ordered the Trump administration to resume output Diversity Visa Every year the State Department uses a lottery system to select visa recipients from a wide variety of countries. In April, President Trump has banned recipients of diversity visas from entering the country.
congress founded the Diversity Visa Program through the 1990 Immigration Act to encourage immigration from under-represented countries in the United States. The law allows up to 55,000 people to be selected, but that limit was lowered to 50,000 in 2017. Only citizens of countries with fewer than 50,000 nationals who have been admitted to the United States in the past five years can apply. Applicants must have a high school education or at least two years of work experience.
After lottery winners have been selected from millions of applicants, they can apply for a visa and must undergo an intensive review to be approved. If the applicant’s visa is not issued by September 30th, the end of the fiscal year, he or she will lose the opportunity to immigrate to the United States.
In April, President Trump announced the travel ban for many immigrants who want to come to the United States permanently because of their close family ties or the diversity category. In June, he extended the ban to the end of 2020 and expanded it to include several nonimmigrant categories, including H-1B workers and their spouse (H-4s), L-1 Visa, and J-1 exchange visas.
When the administration announced the ban, the State Department had only 12,000 diversity visas issued Almost 40,000 lottery winners are waiting in the balance for the 2020 financial year.
The judge issued the order in a hearing on five consolidated lawsuits Challenging the bans for April and June. He failed to take action against other categories of people affected by the bans, including those applying for green cards based on family relationships in the US and those intending to travel on a work visa. Many of these workers work in important industries, including medical.
The judge also failed to extend the late September deadline when the eligibility for a diversity visa expires. However, he ordered the State Department to do so “Use good faith in making decisions about visas” by the deadline.
Why the Trump administration’s justification for banning diversity visas is flawed.
The government used the current economic downturn in the United States to justify the ban, saying it would reduce competition for American workers. However, the prohibition contained no meaningful economic analysis to support this claim and its rationale contradicts that Opinions of economists.
President Trump has been calling for the Visa lottery to end since 2017 when he said the program was up “Pick the worst of the worst. “The government has repeatedly used the COVID-19 pandemic as an excuse to implement its restrictive immigration agenda.
The diversity visa benefits the United States by adding diversity to our immigrant pool and helping to balance the flow US immigration systemTendency to favor individuals who have close relationships with family members or employers in the United States. The Trump administration should not use a global crisis as an excuse to stop this and other immigration flows into the United States.
