July 1, 2020 is the beginning of a new fiscal year. This is also the date on which the Australian Home Office and the state government are introducing new immigration laws and regulations. We have summarized the changes for the Northern Territory regarding the state’s nomination criteria.
General information:
- If you or one of your migrant relatives currently live between states, you will Not eligible for the Northern Territory (NT) nomination
- If you or one of your dependent migrants currently have a student visa and are currently studying at an NT institution, you will Not be eligible for the NT nomination
- If you have already been nominated by the NT for a 489 or 491 sub-class visa, you will Not be eligible for a subclass 190 nomination.
International student graduates Anyone who has studied in the NT can receive a nomination for subclass 190 if they:
- have successfully completed one or more qualifications after completing the NT course at an NT-based institution for two years in a single tertiary course or a series of nested tertiary courses and
- Lived in NT for at least six consecutive months immediately after completing your last qualification * and held a visa that enables full-time work (this requirement does not apply to students who met all course requirements in the semester 2020 and submit a letter of completion before August 1st 2020 before) and
- demonstrated genuine and sustainable efforts to get employment ** from an NT employer in your nominated profession or a closely related skilled profession.
International student graduates Anyone who cannot live in the NT for six months after completing the two-year course in the NT will only be considered for a nomination in subclass 491. You must demonstrate that you have made a real effort to find employment with an NT employer in his nominated profession or in a closely related qualified profession.
NT residents
An NT resident includes those who have a temporary visa with labor rights and are currently residing in the NT. Applicants residing in NT are entitled to a Subclass 190 nomination if you:
- Immediately before applying, show that you have lived in the NT for at least two years in a row
- show that none of your migrant relatives live in another part of Australia, and
- Immediately before applying for an NT nomination, you must continuously demonstrate full-time employment in the NT in an eligible profession for at least two years and demonstrate that the employment is available for at least another 12 months.
Applicants residing in NT are eligible for a Nomination for subclass 491 if you meet the following requirements:
- Applicants who started living in the NT before July 1, 2020 must:
- Show that you lived in the NT at least six consecutive months immediately before application
- show that none of your migrant relatives live in another part of Australia, and
- Full-time employment in NT in an eligible profession for evidence at least six consecutive months immediately before applying for the NT nomination and demonstrate that the employment is available for at least another 12 months.
- Applicants who live in the NT on or after July 1, 2020 must:
- Show that you lived in the NT at least 12 consecutive months
- show that none of your migrant relatives live in another part of Australia, and
- Full-time employment in NT in an eligible profession for evidence at least six consecutive months immediately before applying for the NT nomination and demonstrate that the employment is available for at least another 12 months.
Employment must also meet the following additional requirements:
- The position must be in the NT and the employer must have a record of the trade in the NT for at least 12 months
- Positions that are in serviced office space or that include hot desking agreements are generally Not be rated positively
- They have to be paid at market salary.
Applicants who were not in an eligible profession are generally not eligible for an NT nomination.
Applicants who have worked for at least six consecutive months in a profession that is not an eligible profession can Qualify for subclass 491 in exceptional cases and on a case-by-case basis if you can demonstrate the following:
- The employer has made a real effort to recruit locally, and the position cannot be filled by an Australian citizen or permanent resident. The proof should include at least copies of the advertisements placed and a statement from the employer stating the number of applicants and the reasons why no Australian citizens or permanent residents were recruited
- There is a real need for the position in the company. At the very least, the evidence should include a detailed statement from the employer explaining the need for the position and how the job offer came about
- You have made real and sustainable efforts to find employment in your nominated profession or a related profession in the NT. At the very least, the evidence must include copies / screenshots of applications for relevant jobs and all feedback received.
