The Cumis Teaching
In California and most other states, the insurer must “pay the reasonable cost of hiring independent legal advice if an insurer defends an insured subject to rights, due to a possible lack of insurance coverage [selected] from the insured. “[[[[San Diego Federal Credit Union v Cumis Insurance Society, Inc.., 162 Cal. App. 3d 358, 375 (1984).]
Cumis is representative of a growing case law that gives the insured person the absolute right to choose an independent lawyer if there is a conflict. However, Finley v Home Insurance Companywhere the Hawaii Supreme Court refused to adopt them Cumis Teaching provides the exception that confirms the rule.
Since CumisThe courts have refused to require the insurer to pay the fees of an independent lawyer if “settling third-party claims would not affect the coverage dispute”.
The Cumis Case also allowed for abuse by the unscrupulous. Recent California legislation has provided insurers with tools to control this abuse. Recent decisions also have applicability to the Cumis Teaching. While Cumis is often discussed as a groundbreaking case, it is more important to publicize the key concept than to develop a new rule of law.
