The court proved that Konovalov from April 8, 2014 to May 26, 2014, knowing about the failure in the Sberbank mobile application, opened a currency account, then closed it, and the amount from the account due to a glitch was returned to his card in double size. During the debate, Assistant Prosecutor Vera Muschinina stated that there were 22 such operations. According to her, Konovalov took advantage of the stolen money in full. By the way, the prosecution requested a more severe punishment for Konovalov – 8 years of general regime.

In court, as witnesses for the prosecution were persons to whom Konovalov transferred the money. “Witnesses were questioned during the trial. They confirmed the earlier testimony, which corresponds to the circumstances of the accusation, ”the state prosecutor said during the debate.

A representative of Sberbank also spoke during the debate. In the opinion of the injured party, double crediting to the card after closing the currency account was due to a technical failure. The representative of Sberbank supported the punishment requested by the prosecution.

According to lawyer Konovalov Yevgeny Zimirev, the guilt of his principal has not been proven. Moreover, during the debate, the defender criticized the very qualification of the crime – theft. According to the criminal code, theft is a secret theft. The lawyer insists that Konovalov came to the bank branches openly, presenting his passport. In the application, the man also went under his name. “Talking about a crime in Konovalov’s actions, in the opinion of the defense, is inappropriate due to the absence of an article in the Criminal Code of the Russian Federation, according to which he is guilty and subject to criminal liability,” the lawyer said.

The fact of crediting “extra” money to Konovalov’s cards does not refute the defense. The lawyer tried to dispute the fact that these transfers to Konovalov are imputed as guilt. According to the defense, money that periodically fell on Konovalov cards is an overdraft loan, not a failure.

“The very fact of a failure in the program of Sberbank of Russia was not documented by anything, only employees of Sberbank of Russia were questioned, who claimed a failure, and all of them were not technical workers, whose duties included ensuring the normal operation of the software product. No document confirming the fact of failure was submitted by the injured party during the consideration of the case. Therefore, the statement in the indictment that there is a failure is not motivated at all, ”Zimirev said in court, adding that opening and closing currency accounts is a legal procedure.

After the announcement of the sentence, Sberbank also expressed its position on "BUSINESS Online".

As noted in the official response of the bank to the request for publication, the court gave a legal assessment of the crime committed based on a thorough analysis of all the circumstances of the case and in accordance with the Criminal Code of the Russian Federation. At the same time, the financial institution believes that the harsh sentence could have been avoided if the client had timely informed the bank of the error and voluntarily returned the money. At the same time, Sberbank has already carried out work to optimize the operation of the application in order to prevent similar situations in the future. “To return the stolen cash, the bank will use all the mechanisms and opportunities provided for by the current legislation of the Russian Federation,” the response says.
